Canon law highest law is the salvation of souls Canon 1752 of the Code of Canon Law (the final canon of the 1983 Code) states that the salvation of souls must always be the supreme law in the Church.
In the initial draft, Tucho had ended the declaration with, "And your little dog too!" The bishops, under Cannon Law #1364, are excommunicated , latae sententia i.e. without a trial. The Explanatory Note addressing the 1988 excommunication does not say that the priests and faithful in the SSPX are excommunicated. It states, "formal adherence to the schism" would result in excommunication. The word "formal" in that declaration means that the individual declares, "I don't care what the Pope says, I say..." It cannot just be implied by remaining in the society or assisting at their masses. The dicastery similarly conflates the terms "illicit" and "invalid." Illicit is "against the law", invalid is "having no effect". Isaac's blessing of Jacob was illicit, since he misled his father. None the less, both Isaac and Esau knew it was valid. At worst, SSPX sacraments are illicit. (The members of the Society argue that the state of emergency makes them licit. As the Synodal Church evolves, it is increasingly hard to argue against that position.) They are, however, valid.
